<p>In the Mexican state of Nuevo León, <a href="http://aristeguinoticias.com/3105/mexico/textual-el-dictamen-contra-ciberbullying-en-nuevo-leon-que-criminaliza-redes-sociales/">as of last week</a> [es], anyone who uses social networks to post messages or images that cause &#8220;harm, dishonor, discredit to a person, or exposes him or her to contempt&#8221; can be incarcerated for up to three years.</p>
<p>Defamation is a felony in Nuevo Leon. The local Congress voted to amend the state&#39;s <a href="http://blog.derecho-informatico.org/difamacion-en-nuevoleon/2009/06/11/">already-stringent policy</a> [es] in what lawmakers described as an effort to fight cyber bullying, a legitimate and common problem. But given its broad scope, the law could easily be used to punish individuals who comment on others&#8217; actions or criticize public figures online.</p>
<p>A defamation felon, according to the <a href="http://www.scribd.com/doc/144479384/Frente-Nuevo-Leon-Dictamen-contra-cyberbullying-criminaliza-redes-sociales">new law</a> [es], is defined as someone who &#8220;uses any means to spread, reveal, transfer or transmit one or more images, recordings whether written or audiovisual,&#8221; to cause harm to another person or entity. The law also requires the operator of the website where the defamatory content is posted to reveal the identity of the person who committed the felon, a measure that could easily violate users&#8217; rights to privacy online. If they don&#39;t comply, website operators may be subject to sanctions &#8212; this could leave sites like Facebook and Twitter in the difficult (but common) position of having to choose between respecting the rights of their users and obeying the law in a jurisdiction outside of their own.</p>
<p>On Twitter, the law has met <a href="http://www.sdpnoticias.com/local/nuevo-leon/2013/05/29/silencian-a-tuiteros-con-decreto-de-ley-que-prohibe-cyberbullying-en-nuevo-leon">sharp criticism</a> [es]. Using the hashtag <em>#MurióLaLibertadDeExpresiónEnNL </em>[#FreedomofExpressionhasdiedinNL] many users have identified the reform as an effort to shield politicians and economic elites from accusations of fraud or other wrongdoing.</p>
<p>Free expression advocacy organization <a href="http://www.article19.org/index.php?lang=en">Article 19</a> wrote in a <a href="http://www.animalpolitico.com/2013/05/reforma-contra-bullying-en-nuevo-leon-criminaliza-uso-de-redes-sociales/#axzz2UVHmAcYs">press release </a>that with this reform, the state of Nuevo León</p>
<blockquote><p>&#8230;incumple con las obligaciones internacionales que tiene el Estado Mexicano en su conjunto en materia de libertad de expresión [...] <strong></strong>Pese a las recomendaciones internacionales de despenalizar los llamados delitos contra el honor porque coartan los derechos de libertad de expresión opinión e información&#8230;</p></blockquote>
<blockquote class="translation"><p>&#8230;fails to comply with the international duties Mexico has to protect freedom of speech [...] [The law goes] against international recommendations to decriminalize so-called offenses against honor as crimes because this restricts freedom of expressing, opinion, and information&#8230;</p></blockquote>
<p>The organization <a href="http://articulo19.org/posicionamiento-nuevo-leon-criminaliza-la-libertad-de-expresion/">has called on</a> [es] Governor Rodrigo Medina to use his veto power and require that the local Congress review the amendment with these concerns in mind.</p>

				<content:encoded><![CDATA[<p>Late on Election Day in Venezuela this Sunday, April 14, Internet access through the country&#39;s primary service provider <a href="http://en.wikipedia.org/wiki/CANTV">CANTV</a> was interrupted, according to declarations by the vice president and science and technology minister, Jorge Arreaza. The Anonymous National Telephone Company of Venezuela (CANTV) has been under state ownership since May 2007.</p>
<p>After a hacking wave involving the Twitter accounts of the presidential candidate and current interim president Nicolás Maduro (<a href="https://twitter.com/NicolasMaduro">@NicolasMaduro</a>) [es] and his party, the United Socialist Party of Venezuela (<a href="https://twitter.com/PartidoPSUV">@PartidoPSUV</a>) [es], the Internet across the country was down for about twenty minutes according to users&#8217; declarations and for &#8220;no more than three minutes&#8221; according to the authorities.</p>
<p>Users reported they couldn&#39;t access the service through CANTV and later said that access to the majority of the pages was reestablished except for news and social networks&#8217; sites. Some users reported having difficulties getting online through other ISPs, including Miguel Laversa (<a href="https://twitter.com/MigueLaversa/">@MigueLaversa</a>) [es]:</p>

<p>Later on, Arreaza announced to the press that <a href="http://www.ultimasnoticias.com.ve/noticias/tuvoto/noticiaselectorales/arreaza-caida-de-aba-no-duro-mas-de-3-minutos.aspx">he blocked Internet access for a few minutes </a>[es] to avoid a hacking attempt on the National Electoral Counsel site. The web page was made inaccessible for users outside the country to prevent more <a href="http://searchsecurity.techtarget.com/definition/distributed-denial-of-service-attack">DDoS</a> attacks after it had been under fire since Sunday, according to Arreaza.</p>

				<content:encoded><![CDATA[<p>The Mexican government signed on to <a href="http://en.wikipedia.org/wiki/Anti-Counterfeiting_Trade_Agreement">ACTA</a> (Anti-Counterfeiting Trade Agreement) on Wednesday, July 11, 2012 in Japan&#8230;in the middle of the night in Mexico.</p>
<p>ACTA aims to combat counterfeiting and piracy of intellectual property (copyrighted works, trademarked goods, patented medicines, etc.) by imposing a series of restrictions on the use of digital communications technologies. The agreement includes restrictions on file-sharing, the fair use of copyrighted materials, and a great variety of activities related to freedom of speech and information. The law also affects privacy, as it includes measures to identify users when materials protected under copyright are obtained illegally.</p>

<p>The agreement has stirred a lot of controversy and indignation in the European Union. Many protests and demonstrations against ACTA had a powerful effect on European lawmakers; days before Mexico signed, the European Union Parliament voted against the agreement. It seems unlikely that any European state will ratify the agreement.</p>
<p>The blog <a href="http://blog.derecho-informatico.org/mexico-firma-el-acuerdo-comercial-contra-la-falsificacion-acta/2012/07/11/">Derecho informático</a> [es] extracted the following summary from the official press release published by the Mexican Institute of Industrial Property:</p>
<blockquote><p>Este Acuerdo, firmado por el Embajador de México en Japón [...] pretende una mejor protección internacional de los derechos de propiedad intelectual de los mexicanos, atraer nuevas inversiones, asegurar las fuentes de trabajo ya existentes e incrementar la creación de empleos formales, así como fomentar la creatividad, la innovación y la competitividad de nuestras empresas.</p></blockquote>
<p class="translation">This Agreement, signed by the Mexican Ambassador to Japan [...], aims to improve the international protection of the intellectual property rights of Mexicans, attract new investments, secure existing jobs and increase the creation of more formal jobs, and foster creativity, innovation and competition among our companies.</p>
<p>Mexican netizens showed their outrage for the signature on social networks and online forums. The hashtag <a href="https://twitter.com/#!/search/%23ACTA">#ACTA</a> became a trending topic on the afternoon following the vote. Most complain that the federal government acted against the will of the people and of the Senate itself, as Pepe Flores mentioned in the blog <a href="http://alt1040.com/2012/07/mexico-acta?utm_source=self&amp;utm_medium=banner&amp;utm_campaign=Destacados%2BHome">Alt1040</a> [es]:</p>

The working group, sessions, and the effort of thousands of people didn&#39;t matter. The federal government has disregarded everything with disdain. ACTA is back.</p>

<p>6. Modificará la noción de “uso justo” de material protegido por copyright (regularizará los materiales que se distribuyen con fines informativos, como demos, fragmentos de libros o artículos académicos, videos, etc.).</p>
<p>7. Criminalizará el uso compartido de archivos en línea a través de protocolos Peer to Peer.</p>
<p>8. Limitará el acceso a medicamentos de bajo costo en países en vías de desarrollo.</p>
<p>9. Limitará el uso para los agricultores de semillas patentadas.</p></blockquote>

6. It will modify the notion of &#8220;fair use&#8221; of protected copyright material (it will regulate the materials that are distributed with the intention to inform, such as demos, book excerpts or academic articles, videos, etc.).<br />
7. It will make it a crime to share archives online through the use of Peer to Peer protocols.<br />
8. It will limit access to low cost medicines in developing countries.<br />
9. It will limit the use of patented seeds by farmers.</p>
